Judging the Judge: What Antonin Scalia’s Death Means to the People I Love

I am not sad Antonin Scalia is dead.

Wow! It feels so good to say that out loud!

Come on. Admit it. You probably feel the same way.

I know. I know. Everywhere you turn, people are going out of their way to talk about the ramifications of the 79-year-old Supreme Court Justice’s death without passing judgement on him.

“Let’s keep it classy,” they say.

Oh. Stop it.

In his 30 years on the bench, Scalia hurt an awful lot of people. And I mean real, live people – not ideological constructs, not hypotheticals – but moms, dads, husbands, wives, daughters, and sons.

The aggregate amount of misery in the world was drastically increased by his being in it. And now that he’s gone, much of that misery may be relieved.

So please curb any shock you may feel at my thesis. And spare me the false praise of a truly reprehensible human being.

He was against women controlling their own bodies, efforts to desegregate our schools, an individual’s right to love whomever they choose, refraining from executing mentally disabled or teenage prisoners. Heck! He was even against police reading suspects their Miranda Rights!

This was a person who said black people should go to “slower” colleges, homosexuality was the same as murder or bestiality, sex discrimination is constitutional, and maybe we have a right to all carry around rocket launchers in public.

If it is outrageous to feel relief at the death of this man, you may call me outrageous.

I’m not usually the kind of person who celebrates someone else’s death. Not even a famous person.

But you have to admit that the people we love are a lot better off without Scalia in the world.

It’s not like he kept all this to himself. He wasn’t some lone drunkard in the back of the bar mumbling sexist, racist views. He wasn’t your ancient uncle who you only see twice a year making people uncomfortable at the dinner table. He was a judge in the highest court in the land, and his demented and warped world view drove public policy impacting… well… everyone.

He was the deciding vote in several 5-4 decisions that – if they had gone differently – would have greatly benefited every person in this country.

You can thank him for the Presidency of George W. Bush and Citizens United. Let that sink in for a moment.

Imagine all the horrific blunders of the Bush Presidency – easily the worst administration in my lifetime. If the Supreme Court hadn’t given the highest office in the land to Dubya, arguably we wouldn’t have had the Irag War, the Great Recession, No Child Left Behind, the slow response to Hurricane Katrina – maybe even 9-11.

And if you hate what our elections have become, imagine if we didn’t have the Citizens United verdict. Campaign donations would have to be made in public with some limits on how much individuals and corporations can contribute.

How much better the world would have been without these terrible decisions!

I’m not saying Scalia wasn’t a good man in his personal life. I have no idea what he was like to the people he loved. For all I know he may have been a good friend, a loving husband, father and grandfather. He probably had people he cared about and who cared about him. And to those people I send my condolences.

However, he did great harm to just about everyone else. And for that I feel nothing but relief at his death.

Who am I to bask in such schadenfreude?

I am a father and public school teacher.

I have a seven-year-old daughter and several classes full of mostly impoverished and minority students.

And Scalia’s death is good for everyone I care about.

If he were still alive, there was so much more damage he could have done. Take the Friedrichs case, an important one for teachers like me.

The case is an attempt to strip teachers unions of the right to charge members for their services. If the court rules in favor of Friedrichs, it would overturn decades of established law against free riders. People would be allowed to be in a union, enjoy higher salary and benefits negotiated by that union, but not pay dues. It would be absurd. Yet with Scalia still on the bench, most court watchers seem to think we would have had another terrible 5-4 decision.

However, with Scalia’s death, the best anti-union forces would probably receive is a 4-4 decision – not enough to overturn established law. True the case has already been heard by the justices, but a ruling has not yet been handed down. According to the Supreme Court blog, even if Scalia had already written a ruling on this matter, it would be void. Any rulings he wrote that have not yet been made public don’t count.

So the most likely outcome now is that millions of people will continue to be protected from unfair labor practices. And you expect me not to have a big ‘ol smile on my face!?

So where do we go from here?

President Barack Obama will select who is to succeed Scalia. Numerous excellent choices have been floated. If Obama chooses any one of them, he would probably tilt the court fractionally to the left.

Before the body was even cold, Republicans vowed to block any nominee Obama makes until the next President is sworn in. Some are trying out the talking point that Supreme Court Justices have never been sworn in during an election year. But if that were true, we wouldn’t have Justice Anthony Kennedy who was confirmed during the last year of Reagan’s presidency.

Funny. The U.S. Constitution clearly states that the President has the right to nominate Supreme Court Justices with the advice of Congress. Yet so many of these right leaning partisans who considered themselves Constitutionalists last week suddenly find themselves against that revered document today.

I wonder how Scalia would have argued such a situation.

Not really. He was the one who taught the rest of his party how to twist the words of the founding fathers to mean whatever the far right favors this week.

Obama still has more than 300 days in office. If Republicans try to block his nomination until a new face tops the Executive, it would be the longest such obstruction in a century. Of sitting justices, the longest confirmation period was for Clarence Thomas who took 106 days to be approved by Congress.

And that brings us to the 2016 Presidential race.

Scalia’s death is likely to have a huge impact on whom becomes our next President.

If Republicans block Obama’s Supreme Court nominee, it would probably increase voter turnout. Whenever that happens, it favors Democrats since they have more registered members than the GOP.

Either way, Scalia’s death is probably beneficial to whomever the Democratic nominee will be. If either Hillary Clinton or Bernie Sanders get the nomination, supporters of the defeated candidate are more likely to support the reigning Democrat.

Even if voters don’t like the winner’s policies as much as their preferred candidate, they’re likely to support the nominee in order to continue tipping the Supreme Court to the left. After all, three additional justices are 70 or older. Stephen Breyer is 77, Anthony Kennedy is 79, and Ruth Bader Ginsburg is 82.

We have had a long haul these last 15 years. Much social progress has been stalled.

But now that Scalia is out of the picture, the future looks bright.

Maybe things really will turn out alright. Maybe we’ll actually have a chance to build that better world we’ve all been dreaming about.

Rest in Peace, Scalia. The nation can’t wait to move on without you.

Why Aren’t Public Schools Too Big To Fail?

There’s a new fad sweeping the nation.

It’s called “Educational Accountability.” Here’s how it works.

If your neighborhood school can’t afford to pay its bills, just close it.

That’s right. Don’t help. Don’t look for ways to save money. Don’t look for new revenue. Just lock the doors.

It’s fun! And everyone in the federal and state government is doing it!
It’s the saggy pants of United States education policy. It’s the virtual pet of pedagogical economics. It’s the cinnamon challenge of learning-centered legislating.

Sorry, poor urban folks. We’re closing your kids’ school. What? Your little tots are entitled to an education!? Fine! Take them to some fly-by-night charter or else they can get stuffed into a larger class at a traditional school miles away. It’s really none of my business.

Meanwhile, as government functionaries pat themselves on the back and give high fives all around, academic outcomes for these children are plummeting.

Moving to another school rarely helps kids learn. They lose all their support systems, social networks, community identity, and self esteem while spreading resources even thinner at their new location often putting it on the chopping block for the next round of closings. Or worse they’re subject to the unregulated whims of a for-profit company devoted to cutting student services in the name of increasing shareholders profits until some charter CEO shutters the building, himself, and sneaks away like a thief in the night.

But what else can we do? If a school can’t pay its bills, it’s got to go. Right?

Wrong.

Is it really so surprising that poor schools can’t pay their bills? We force them to make ends meet by relying heavily on taxes from local residents – most of whom are dead broke!

How is someone who can’t feed himself going to support a robust school system? How is someone working three minimum wage jobs going to have enough left over at the end of the week to fund a broad liberal arts education? How is someone with the wrong skin color who can’t get a home loan or a well-paying job going to provide the capitol necessary for a 21st century learning experience?

But whatever. Close the poor schools and blame it on the poor.

Tee-Hee!

Chicago, Detroit, Philadelphia, Puerto Rico – You have to admit, there’s a kind of glee about the whole prospect. It’s one of the few things that both Democrats and Republicans agree on.

In fact, they love it so much they’ve found all kinds of excuses for shuttering schools that aren’t even so obviously based on their budgets.

Look at how we evaluate schools effectiveness.

Does your school serve a mostly poor, undernourished, minority population who start kindergarten already years behind grade level? Those kids need help. They need extra assistance, tutoring, counseling, health screenings, and a whole host of wraparound services. But instead of providing any of that, we demand one factor – the school – provide everything without providing them any resources.

That’s like judging a soup kitchen by weighing its customers before you give them any soup!

My God, Man! This poor fellow is malnourished!

Yes, he came in that way.

What are you putting in that soup!?

It doesn’t matter. He hasn’t had any yet. Besides. He needs more than just soup.

Enough of your excuses! I’m closing you down!

Moreover, we use the worst possible measurements of student achievement – standardized test scores – to tell if our schools are doing a good job. Never mind that these sorts of assessments repeatedly have been shown to demonstrate parental income more than academic achievement. And surprise! Surprise! They show our poor kids have poor scores!

And just in case a few kids somehow manage to overcome the odds, we sabotage the learning they might otherwise get from their schools with top down policies like Common Core State Standards.

How does this cripple educational outcomes? By hobbling the one group most in a position to actually make a difference – teachers.

Instructional autonomy? Bye! Bye! After all, who wants to hear from the people on the ground who can empirically judge the situation, determine what needs to be done and how best to do it? Instead, we give the power to think tanks and the testing industry to decide what is taught, when and how.

Common Core has never been proven to help kids learn. In fact, most teachers despise it, saying the standards are developmentally inappropriate, ill-conceived and unwieldy. Even under the best of circumstances, why would you take someone who barely has the resources to get by and then make things MORE difficult? That’s like taking an 80-pound starving child and forcing him to lift a 200 pound barbell over his head in order to qualify for his dinner.

Put your back into it, youngster!

I’m trying, Sir, but I’m so hungry.

Just use your grit!

Grits! Yes, please. I’m famished.

So what do we do? We close their schools! That’ll show ‘em!

And somehow we call this accountability.

Would you solve a measles outbreak by closing the hospital? Would you solve a burning building by closing the fire department? Would you solve an asteroid hurtling toward Earth by closing NASA!?

NO! OF COURSE YOU WOULDN’T!

In fact, when the wealthy are at a disadvantage, we do just the opposite.
Take the banking industry.

When Wall Street crashed the economy with risky speculation and absurdly short-sighted practices, did we close the banks?

No way! We bailed them out.

Why? They were too big to fail.

If we had let them spiral into insolvency – which everyone agrees they deserved to do – it would have had too large an impact on the country. Middle class folks would have lost their savings. Retirees would have lost their pensions. Businesses throughout the nation would have closed. The economy would have come to a grinding halt.

So the federal government saved the banks.

Now clearly there should have been strings attached to this bail out. Those responsible for the crash should have been prosecuted and forced out. At very least, the banks should have had to make concessions such as more regulation and stopping the risky practices that crashed the economy in the first place. (SPOILER ALERT: That didn’t happen.)

However, the idea was sound.

But why does it only apply to the big banks? Aren’t there other areas of public life that are too big to fail? And isn’t public education one of them – perhaps the biggest one?

Heck! Unlike the banks, our schools did nothing to deserve these wholesale closures. In fact, they’ve done an amazing job with the few crumbs we force them to subsist on.

Moreover, the result of letting them shut down would be just as catastrophic for our nation as a banking collapse. Maybe more so.

If our schools fail, we won’t have educated citizens. Future generations won’t be qualified for any but the most menial of jobs. They won’t be able to navigate the media, commerce, politics, science or any domain of civic responsibility.

Without our schools, we’ll calcify the economic structure. The rich will stay rich, the poor will stay poor and there will be next to no social mobility. Our country will exist as a neo-feudal state and most of us will be relegated to little more than serfs.

Is it too cynical to suggest that this is exactly why we haven’t bailed out our schools? The overwhelming majority of our nation’s wealth is held by only 1% of the population. Disinvesting in public education is exactly the kind of thing that would ensure the status quo is maintained or perhaps even tilted further in the favor of the super rich.

Any sane society, wouldn’t let this happen. If we don’t want this nightmare scenario, it’s time to bail out our schools.

Seriously. The federal government should step in.

Provide a huge influx of cash to the poorest schools so every institution of learning can count on adequate, equitable, sustainable funding. Stop judging them based on high stakes test scores. Stop sabotaging them with social schemes like Common Core. Let the experts – the teachers – actually run their own buildings.

This is what almost every other major country in the world does. Funding is federal. Policy is local. Get with the times, America!

And you can pay for it by enacting a fair tax plan. Worldwide, American companies keep 60 percent of their cash overseas and untaxed. That’s about $1.7 trillion annually. Imagine what that kind of revenue could do for our public schools!

Imagine if we taxed risky Wall Street speculation. Imagine if we made the super rich pay their fair share with tax rates similar to those we had when our national economy was at its best – the 1950s and ‘60s.

You want to make America great again? This would do it? You champion personal responsibility? This is what responsible government would do.

After all, what’s the purpose of government if not to create a level playing field for the next generation?

Call it a bail out, if you want. Or more accurately call it being answerable to the future, taking charge, rising to meet our duties, true accountability.

Stop closing public schools. Save them.

The Theft of a Great American School: José Meléndez Ayala Elementary

They came in the early morning like thieves in the night.

The predawn chill was still in the air.

But employees of Puerto Rico’s Department of Education (DOE) were already at work closing a beloved public school.

They sneaked into José Meléndez Ayala Elementary Tuesday around 4 a.m. taking out desks, chalkboards and any equipment that could be repurposed. Then they loaded it all into trucks and zoomed off.

By the time the sun had risen, it was all over.

In the morning light, parents and children staggered to their neighborhood school in the Manatí region of the U.S. territory to find it an empty shell.

For 9 months they had been camping out in front of the building during the day to stop anyone from doing what had just been done.

“Tears were shed by parents and children. We will never forget,” says Mercedes Martinez, president of the Federación de Maestros de Puerto Rico (FMPR) – the teachers union.

Even though the school was one of 150 closed in the past 5 years, roughly 35 community members refused to let government employees step foot inside.

For about 180 days, they had kept the DOE away with placards and slogans like “This is my school and I want to defend it,” and “There is no triumph without struggle, there is no struggle without sacrifice!”

Officials hadn’t even been able to shut off the water or electricity. Until now.

The community had hoped to convince the government to reopen the school.

Parents went to Governor Alejandro García-Padilla’s mansion and spoke with his assessors, members of the legislature, the Secretary of Education Rafael Román, regional officers from the DOE, candidates for both major parties, and members of the municipal assembly.

“All stated their support except the DOE,” Martinez says. “But nothing was done.”

The municipal assembly even passed a resolution requesting the school to be reopened. It never happened.

The Commonwealth Senate sent its education committee to visit the school and inspect it. They made a recommendation to reopen it.

It never happened.

“The Secretary of Education didn’t answer,” Martinez says. “He’s behind all this.”

Manatí’s Mayor Juan Aubín Cruz Manzano may have wanted the building to use for anther purpose.

“The Secretary of Education confabulated to give it to him, as he handed him two other schools he shut down in Manatí for the mayor to use the buildings as he pleases,” Martinez says.

Perhaps most hurtful, says Martinez, is that employees of the DOE weren’t alone in looting the school.

After the DOE left, teachers from other schools came to take whatever free materials were left behind, she says. They were directed to do so by principals who had never supported the occupation.

“It was shameful,” Martinez says. “Now this building will become part of the obsolete infrastructure. Parents are demoralized.”

Community members whose children went to the school now have to pay to transport their kids to new schools miles away. With drastic budget cuts, these remaining schools often have class sizes of 35 students or more. Amenities like arts, music, health and physical education have typically been slashed.

The island territory’s financial woes stem from a flock of steady circling vulture capitalists encouraging damaging rewrites to the tax code while buying and selling Puerto Rican debt.

Hundreds of American private equity moguls and entrepreneurs are using the Commonwealth as a tax haven.

Since 2012, U.S. citizens who live on the island for at least 183 days a year pay minimal or no taxes, and unlike those living in Singapore or Bermuda, they get to keep their U.S. passports. After all, they’re still living in the territorial U.S. These individuals pay no local or federal capital gains taxes and no local taxes on dividend interest for 20 years. Even someone working for a mainland company who resides on the island is exempt from paying U.S. federal taxes on his salary.

Big corporations are taking advantage of the situation, too.

Worldwide, American companies keep 60 percent of their cash overseas and untaxed. That’s about $1.7 trillion annually.

Microsoft, for instance, routes its domestic operations through Puerto Rican holdings to reduce taxes on its profits to 1.02 percent – a huge savings from the U.S. corporate tax rate of 35 percent! Over three years, Microsoft saved $4.5 billion in taxes on goods sold in the U.S. alone. That’s a savings of $4 million a day!

Meanwhile, these corporate tax savings equal much less revenue for government entities – both inside and outside of Puerto Rico – to use for public goods such as schooling.

Public schools get their funding from tax revenues. Less tax money means less money to pay for children’s educations. As the Puerto Rican government borrowed in an attempt to shore up budget deficits, the economy tanked.

But have no fear! In swooped Hedge Funds to buy up that debt and sell it for a profit.

When this still wasn’t enough to prop up a system suffering from years of neglect, the Hedge Fund managers demanded more school closures, firing more teachers, etc.

Wall Street greed has devoured another public school. But the battle for public education goes on.

Tania Ginés, the community leader who organized the occupation for so long says she is not defeated.

“I have decided to become the voice of those with no voice and will continue organizing parents throughout the island against any more School closings.”

“These are our schools, our children’s schools. The government of the slogan ‘Put Children First’ just demonstrated one more time that it’s just that – an attractive slogan they’re not willing to live by.”

The Teachers Federation supported the parents 100% and wants to recognize this humble community for its big heart, says Martinez.

“We want to show the world what a true revolutionary is. Che Guevara once said that the “true revolutionary is guided by a deep love feeling.’ These parents showed him to be true.”

Every student with special needs in the United States is guaranteed a Free and Appropriate Public Education under national law.

 

So why has the U.S. territory of Puerto Rico stopped paying its special education teachers?

 

More than 100 parents, therapists, psychologist, occupational therapists, students and teachers marched on Monday to the capital in San Juan to find out.

 

The rally began in front of the legislature at 9 before protesters marched to the governor’s mansion at 10:30 am. Demonstrators then met with representatives of Governor Alejandro García-Padilla.

The answer may be a crippling $72 billion debt. Puerto Rico is besieged by vulture capitalists encouraging damaging rewrites to the tax code while buying and selling the territory’s debt.

 

The Commonwealth government has been prioritizing payments to American private equity moguls instead of services for communities such as public schools.

 

“Our Children Before Vulture Capitalists,” proclaims one protestor’s sign.

Jinnette Morales agrees with the sentiment. Morales organized the protest.

 

“No credit line would back up this lack of payment,” says the mother of a child with Down Syndrome.

 

 

“These therapists have been working for months without pay and if Secretary of Education Rafael Román says that he has paid them, I want to hear him say that when we take him to court.”

Though the Commonwealth Department of Education hasn’t paid these professionals in up to six months, students still have been receiving services. Special education employees have been working without pay. However, that can’t continue indefinitely.

 

The therapists, psychologists and teachers have had enough. They simply can’t continue without an income.

 

So starting this week, roughly 1,200 students are without services they are guaranteed by law.

“We are talking about children’s humans rights to receive an appropriate and quality education,” says Mercedes Martinez, president of the Federación de Maestros de Puerto Rico (FMPR) – the teachers union.

 

 

“Children need these therapies to progress in their development. Therefore, we stand with the workers, parents, and students and demand action from the governor of our country.”

 

Protesters are demanding special education employees be paid immediately so child services can continue with as little interruption as possible.

 

After arriving at the governor’s mansion, activists met with the governor’s attorneys.

 

They were told the government will eventually pay the special education teachers, says Martinez. In the meantime, officials suggested improving billing for services. Instead of having all invoices be digitized and go through corporate channels, special education teachers can provide manual bills. This will shorten the amount of time between billing and payment.

 

Protesters are scheduled to meet again with government officials on Thursday to pin down an exact date when payments will begin.

 

Until then, many demonstrators are camping out in front of the governor’s mansion vowing not to leave until the government makes good on its fiscal responsibilities to teachers and students.

“The government needs to pay the debt with these professionals before our country’s debt,” says Martinez.

 

“Our children should come first.”

 

 

This monetary crisis is imported from the mainland. Legislation is being manipulated by corporate interests profiting off the chaos. Moreover, hundreds of American bankers and entrepreneurs are using the Commonwealth as a tax haven.

 

As a result, tax revenues are drying up while the super rich rake in profits.

 

Officials warn the government may be out of money to pay its bills sometime this year. Over the next five years, it may have to close nearly 600 more schools – almost half of the remaining facilities!

 

Of the 135 schools closed in just the last two years, Román had originally proposed shuttering 200. The remaining 65 were only kept alive because communities occupied the buildings and refused to let the government step in.

 

Despite Wall Street manipulation, Puerto Rican communities aren’t letting their government sell their children short. The fight goes on.

Unions Can’t Just Be About What We’re Allowed to Do: Social Justice Unionism

If labor unions were an animal, they’d be an old hound dog napping on the porch.

They’re slow to get up and chase away burglars but they do like to howl at night.

Most of the time you don’t even know they’re around until the dinner bell rings. Then that ancient mutt is first to bolt into the kitchen to find a place at the table.

It’s kind of sad really. That faithful old dog used to be really something in his youth.

He was fierce! He’d bark at trespassers even tearing them apart if they threatened his patch of land.

Old Uncle Sam used to yell at him and even threaten the pooch with a rolled up newspaper, but that dog didn’t care. He had a sense of right and wrong, and he didn’t mind getting into deep trouble fighting for what he thought was fair.

Today, however, the only thing that really riles him is if you threaten to take away his ratty old bone.

Let’s face it. Unions have become kind of tame. They’re housebroken and not much of a threat to those people waiting in the shadows to rob us blind.

Some people say we’d be better off without them. But I don’t agree. Even a decrepit canine can act as a deterrent, and thieves sure are frightened of dogs.

Think about all unions have given us: the weekend, child labor laws, vacation time, pensions, lunch breaks, healthcare, the 8-hour day, maternity leave, safety measures, due process, sick leave and free speech protections on the job!

They didn’t get us all that by sitting politely at the table with their hands crossed. They didn’t do all that by contributing modest sums to political campaigns. They didn’t do it by obsessively protecting collective bargaining at the expense of all else.

Unions used to take to the streets. They took over the job site. They marched with signs and placards. They exercised people power.

And the government was scared of them. The President called out the army to get them back to work. Lawmakers hired mercenaries to break strikes with clubs and guns. But eventually Congress passed laws to placate them.

Unfortunately, That was a long time ago.

For decades the pendulum has been swinging against us. Federal and state laws have become increasingly restrictive. They want to tell us when we can strike and how long. They want to tell us when and if we can collect dues. And – frankly – they want to tell us to just disperse and do whatever the bosses want – because the business class has already bought and paid for our politicians.

For decades we’ve heard to their propaganda on TV, the radio and the print media. Well-paid shills have poured their poison in our ears about the evils of the labor movement. They’ve spoken these lies so often lots of people believe them.

Workers used to fight to make sure everyone got a fair deal. Now the working man has been brainwashed to focus instead on making sure no one else gets more than him. And the bosses are laughing all the way to the bank.

Union membership is at the lowest it’s been in a century. So are wages adjusted for inflation. A family of four used to be able to get by comfortably on one salary. Now it can barely make ends meet with two.

Yes. There’s no doubt about it. We need unions today more than ever.

But for unions to survive, they must change. They have to become a reflection of the membership and not just of the leaders.

During this presidential election cycle, we’ve seen our largest national unions – the National Education Association (NEA) and American Federation of Teachers (AFT) endorsing a candidate without bothering to actively poll their members. We’ve seen them speak for us on policy decisions without asking our opinions. We’ve seen them act just like the corrupt politicians who we should be fighting against.

Yes, it is time for a change. No longer can our unions be run from the top down. They must be run from the bottom up. They shouldn’t tell us what to do. We, the membership, should be giving orders to them.

Moreover, we need to stop obsessing about collective bargaining. I’m not saying that’s unimportant. But it can’t be the only thing we do.

Our unions used to be in the midst of larger social movements. We were part of the Civil Rights movement. We were part of the push for desegragation. We were part of the fight to protect children and provide them a decent education.

We need to continue that today. And in some places we are already doing that! Look to Chicago, Detroit and Philadelphia. Teachers unions in those urban areas are fighting not just for better pay and benefits but for the communities they serve. Detroit teachers en mass are calling off sick to protest horrible conditions in the schools. Chicago teachers are marching in the streets with the community to demand indictments for police murdering their black and brown students. Philadelphia teachers are supporting students who walk out of class to protest state disinvestment and toxic testing.

THIS is what unions should be doing. We should be fighting for social justice. We should be a central part of the struggle to turn the tide against corporatization, privatization and standardization of our country’s public goods. We should be marching hand-in-hand with BlackLivesMatter activists. We should be in the front lines of the fight to save our environment and replace fossil fuels with renewable energy.

We must be part of the community and not apart from it. We must share in the struggles and goals of those we serve. We must be an example of the old truism that a rising tide raises all ships. After all, the word “union” literally means together. By definition we must all be in this together or else we’re not even really a union.

And to do this we have to stop being so concerned with what they tell us we can do.

We live in a democratic society. The government gets its power from us, from our consent. That means that if there are enough of us, we trump their corrupt laws. They only get to make those laws because we say so. And court decisions – even Supreme Court decisions – mean nothing next to the court of public opinion.

The bosses buy the politicians and tell them to legislate us into a box. It’s time to break out of that box. We can’t be afraid to take our power back. We shouldn’t be afraid of our government. Our government should be afraid of us.

How do we do it? Organize.

If you belong to a union, roll up your sleeves and get active. Run for office. Convince like-minded folks to join you. Take over your local. Spread to your national.

If you don’t belong to a union, start one at your job. Talk to your co-workers. Talk about the benefits for each of you and your neighborhoods. Fight for your rights.

I know. It’s a whole lot easier to complain. Real change, though, takes real work.

We used to know these things. Somewhere along the line we forgot.

So wake up, you yeller cur dog, and get off the porch. Take to the streets.

Because the surest way to take back our country is to take back our unions.

Gov. Rick Snyder Should Be Forced to Drink Nothing But Contaminated Flint Water for the Rest of His Life

As I write this, I have a fresh glass of ice cold water sitting next to me.

It is so clear I can see the wood grain of the the table through it. When I put it to my mouth, my lips almost go numb from the cold.

I gulp down way more than I should. In moments, it seems, the glass is empty.

Nothing satisfies like a crisp simple glass of water.

But in Flint, Michigan, that straightforward, easy pleasure can kill you.

And-or poison your children, cause learning disabilities, hearing loss, vomiting, high blood pressure, pain or numbness in the extremities, infertility or miscarriage. Among a host of other equally terrible maladies.

From the water.

Nine months ago the state officials who took over running Flint because the city was just too darn poor for self government, they shut off the flow of already treated Lake Huron water from Detroit. They replaced it with untreated raw water from the Flint River. The plan was to save money by treating this water, themselves, from a source that had been continually polluted for decades by the disappearing auto industry.

However, this noxious brew corroded the pipes, stripped out the lead and put it right into the water glasses Flint parents were using to hydrate their children.

More than 8,500 children. With high amounts of lead in their blood. Suffering untold injuries. For life.

Oh and the overwhelming majority of them are African American and/or impoverished. Whoops!

Gov. Rick Snyder has been defensively apologizing for this disaster. He knew all about it long before the taps were shut off. He even released a slew of inter-office emails about the situation where officials play pass-the-buck as Flint residents gulp down this filth from their faucets. As citizens complained about the water’s color and odor. As physicians protested it wasn’t safe for human consumption.

Even now Snyder STILL says people can safely bathe their children in this dirty, smelly, poisoned water. Just make sure the kiddos don’t drink it. In fact, he says he wouldn’t mind bathing his own grandchildren in this mess.

Yeah. Kinda takes away any sincerity from his “apology” and his statement that he’s responsible, doesn’t it?

Why isn’t this man in jail? Why is he still in the Governor’s mansion?

If we lived in a just country, this poor excuse for a human being would AT VERY LEAST be locked away in a dungeon somewhere never to sting our eyes at the sight of his repulsive face. A more appropriate punishment would be making him drink nothing but his own contaminated Flint tap water for the rest of his life as he suffers from the effects of lead poisoning – like all those thousands of children he helped poison to save a few bucks.

But no. In the America where we live, his only mistake was getting caught. And now he’s losing political points having to apologize without really doing much. Yeah, he’s called in the National Guard to help deliver bottled water. Yeah, he’s turned back on the Lake Huron water, but Flint’s pipes are already ruined so lead is still leaking into the water. Why are these poor people still being charged with a water bill for something they can’t use? No one except for Grandpa Rick Snyder would use this foul stuff for anything!

Meanwhile, Darnell Earley, the emergency manager appointed by Snyder who actually switched Flint’s water in the first place is at a new government job. He’s emergency manager of another Michigan public service – Detroit Public Schools! Dilapidated buildings, fungus growing on the walls, slime leaking from the ceiling, broken toilets – a state-provided learning environment overseen by this functionary who’s doing a heckuva job! Teachers trying to raise awareness of the situation have staged a series of “sickouts.” But Snyder’s administration still doesn’t have any money to waste on Detroit school kids – just like it didn’t have any money to provide potable water to Flint residents.

And the cycle continues. Crap gets flushed from one source to another – and I’m not talking about the Flint water system!

You can try to make justifications and excuses, but the lie gets awfully thin in Michigan. And if you think this is the only place where business trumps public welfare, you must be drinking from Snyder’s water cooler. Chicago, Philadelphia, Atlantic City, the entire island of Puerto Rico! Terrorists with government jobs are slowly dismantling our metropolitan areas, our public goods, everything that made America great!

And what the heck is being done about it? A lot of news stories, talking heads shaking their noggins and pointing their fingers everywhere except where the blame really lies.

It’s enough to drive one to drink.

Speaking of which, excuse me while I take another swig from my water glass.

Ah!

No, I don’t live in Flint. But this sure isn’t tap water. Are you kidding me?

In Pennsylvania we’ve had too many scares with Giardiasis and other bacteria in our municipal water occasionally making us sick.

I pay extra to bring this water to the house in huge jugs and put it on a machine that keeps it ice cold and refreshing anytime of the day or night.

Some people can’t afford it.

What are they to do?

Can anyone really feel safe drinking from the tap ever again?

What kind of a world is it where we can’t even trust the water?

What kind of world are we leaving for our children?

We are all a few months from becoming Flint.

It could already be happening.

Will we let it?

Hundreds Gather in Puerto Rico on Martin Luther King Day Demanding Arts Education

They came with trumpets, tubas, bongos and acoustic guitars.

They came with brightly colored banners and freshly painted posters.

They came armed with songs, dances and slogans.

More than 500 teachers, students and college professors marched to the Puerto Rican capital of San Juan to demand the island government bring back public school arts classes.

The group of activists calling itself Let’s Save the Arts has been fighting against the narrowing of curriculum for the last three years.

At that time, the island Department of Education changed the length of class periods at all public schools in the U.S. territory.

Students used to have seven class periods of 50 minutes each. Now students have six class periods of 60 minutes each. In effect, officials eliminated one class.

Students still receive Spanish, Math, Science, Social Studies, and English instruction. However, now they have to choose between Physical Education or Arts where they used to be able to do both.

Secretary of Education Rafael Román approved the measure to save money. More than 3,000 half time teaching positions were lost.

“It was an austerity measure,” says Mercedes Martinez, president of the Federación de Maestros de Puerto Rico (FMPR) – the  teachers union.

“They’re saying these teachers are not needed.”

Senator Rossana Lopez has proposed a solution. She introduced Bill 584 – legislation that would require all Commonwealth schools to include arts courses as a graduation requirement.

Arts teachers across the island formed the collective group to help pass the measure.

“Having a holistic  education is a right and not a privilege,” said Carlos Vélez, an art teacher from Ángel Sandín Martinez Middle School in the Vega Baja region.

“The study of the arts benefits all students – especially those living under poverty that can’t pay for art courses elsewhere.”

The teachers union issued a strong statement of support.

“Students were off school Monday,” Martinez says. “In symbolism to MLK’s holiday celebration, they protested the best way they know: performing.”

During those performances, Román, the architect of the plan to eliminate the arts, changed his tune. While at the rally, he said he supports the bill.

However, the Secretary of Education could make most of these changes, himself, without legislative action. He could return the alignment of class periods to their previous configuration tomorrow.

“We’re waiting for him to put words into action,” Martinez says.

Meanwhile, supporters hope Bill 584 will pass before this Congressional session ends in June.

Corporate education reform measures like this one limiting arts classes are a consequence  of financial woes imported from the mainland. Puerto Rico is besieged by vulture capitalists encouraging damaging rewrites to the tax code while buying and selling the territory’s debt.

Hundreds of American private equity moguls and entrepreneurs are using the Commonwealth as a tax haven.

As a result, tax revenues to fund public goods like education are drying up while the super rich rake in profits.

Officials warn the government may be out of money to pay its bills this year. Over the next five years, it may have to close nearly 600 more schools – almost half of the remaining facilities!

Of the 135 schools closed in just the last two years,  Román had originally proposed shuttering 200. The remaining 65 were only kept alive because communities occupied the buildings and refused to let the government step in.

The people of Puerto Rico aren’t letting their government defund and defraud their public schools without a fight. Monday’s musical and artistic protest was just another note in the battle hymn of the people.

Bernie Sanders is Right: We Should Federalize Public School Funding

Bernie Sanders just dropped a massive dose of truth on us Monday night.

No politician in my lifetime has ever said anything so dangerous, fraught with problems, unlikely, impractical, and absolutely on the nose right!

The Presidential candidate running for the Democratic nomination wants to make the federal government largely responsible for funding public schools. Right now districts are supported mostly by local and state taxes.

This is what he said:

“One of the things that I have always believed is that, in terms of education, we have to break our dependency on the property tax, because what happens is the wealthiest suburbs can in fact have great schools but poor, inner-city schools cannot. So I think we need equality in terms of how we fund education, and to make sure the federal government plays an active role to make sure that those schools who need it the most get the funds that they deserve.”

Wow! What a statement!

Don’t tell me that was focused grouped. Don’t tell me his campaign did a poll first. Don’t tell me he ran that by any big donors for approval.

Whether you agree with it or not, such an audacious remark has to come from a genuine belief. This is really what Bernie thinks, and it’s entirely consistent with the Democratic Socialism of his whole political career.

I don’t think his rival for the party’s nomination, Hillary Clinton, will be parroting THIS stance! If anything, she might criticize him for it. And she’d have a multitude of practical reasons to do so.

Lots of folks on both sides of the aisle are sick of federal intervention in our schools. No Child Left Behind was a disaster. Race to the Top was worse. And the just passed Every Student Succeeds Act (ESSA) amounts to a massive giveback of power to the states. Under the most popular interpretation, the reauthorization of the federal law governing K-12 schools makes the states responsible for filling in the details of education policy while limiting federal interventions.

And now Bernie is suggesting the Fed foot the bill!?

That is going against the political tide. Who would vote for such a thing? Probably not Hillary. Or any of the Republican candidates. Or more than a handful in Congress, either.

But it’s exactly the right thing to do.

The reason?

The biggest problem with America’s public school system isn’t test scores, lazy students, or teachers unions. It’s poverty, segregation and inequitable funding.

We have separate schools for the rich and separate schools for the poor. We have schools serving mostly black and brown populations and schools serving mostly whites. And the way we allocate money and resources to these schools both allows and perpetuates this system.

Nationwide, state and local governments spend 15 percent less per pupil on poor school districts. I see this first hand. My home state of Pennsylvania is the worst offender, providing the poorest districts an embarrassing 33.5 percent less per student. This means higher class sizes, less teachers, less arts and humanities, less electives, less nurses, guidance councilors and wrap around services. This is the reality in 23 states.

An additional 23 states do buck this trend with more progressive funding formulas. States like California and Florida actually provide MORE spending to poor districts. This helps heal the wounds of malnutrition, violence, family instability and a host of other problems that go hand-in-hand with generational poverty. It also offset the costs of greater numbers of special education students and English Language Learners you typically find in these districts.

You might say, then, that the states where poor children get shafted could simply follow the lead of their more enlightened neighbors. Good luck with that! Rich folks rarely volunteer to subsidize the poor. They got theirs, and they vote and donate more regularly to local politicians than their indigent brethren can afford to do.

The result is a funding system based on local wealth. Rich areas have Cadillac education systems. Poor areas have dilapidated ones. That’s demonstrably unfair and leads to worse academic outcomes for needy kids.

What’s worse, no one else runs their schools this way. The U.S. is one of the only countries in the world – if not probably the ONLY country – that funds schools based largely on local taxes. Other developed nations either equalize funding or provide extra money for kids in need. In the Netherlands, for example, national funding is provided to all schools based on the number of pupils enrolled. But for every guilder allocated to a middle-class Dutch child, 1.25 guilders are allocated for a lower-class child and 1.9 guilders for a minority child – exactly the opposite of the situation in the U.S.

Federalizing education funding could solve all these problems. It could set the groundwork for an even playing field. All students could get a fair start in life! That’s a goal worth shooting for! And that’s what Bernie is suggesting.

But it’s an incredibly dangerous proposal.

Our school system still suffers nationwide from the effects of corporate education reform. National policy has been and continues to be one of high stakes standardized testing, poorly conceived and untested academic standards, and a push to privatize struggling schools. Corporatists call this “Accountability.”

It goes something like this: raise your test scores or we’re closing your school and turning it into a for-profit charter. Adopt these academic standards written by the testing companies and we’ll give you a couple extra bucks. De-professionalize teachers with junk science evaluations and hiring under-trained Teach for America temps or else we’ll cut your funding.

THIS is the federal legacy in education, and Bernie is suggesting we give them MORE POWER!?

Yes, and no. I can’t speak for Bernie, but that’s certainly not how this has to go. We can increase the Fed’s responsibility for funding schools without increasing its power over education policy. In my view, education decisions should be made locally, and I don’t mean at the state legislature. Decisions about how best to run schools should be made at the district level by the experts – the teachers and parents.

Certainly there will be those who call for more federal power over policy as a condition of federalized funding. But that has to be a deal breaker. Equitable funding with inequitable policy would just be plugging one hole while making another.

In my view, equitable funding IS the role of the federal government in public education. When the Elementary and Secondary Education Act (ESEA) was first passed in 1965, it’s purpose was to make sure all schools were getting adequate resources. Under Bush and Obama, that became perverted to mean more standardized tests and philanthro-capitalist interventions. Bernie’s suggestion could be a step in returning to the original intent of the law.

Yes, the Fed should be engaged in accountability. It should make sure it’s funding schools properly. Maybe it should even be responsible to make sure those funds are being spent on things that broadly can be construed as education. I don’t mean that the fed should be able to withhold monies from districts with low test scores. But maybe it can prosecute administrators who use funding to lavishly redecorate their offices or who neglect the needs of students in their districts.

However, even if you agree – as I do – that this is a lofty goal, it is almost impossible to achieve. It’s like single-payer healthcare was in the ‘80s and ‘90s. This is what most of the world is doing but it was completely out of reach here politically. In fact, we still don’t have it, but look at how the landscape has changed. Obamacare is not-single payer, but it is a step in that direction. Bernie is even championing going that extra step and providing a medicare like system for all.

What seemed impossible decades ago, now seems within reach. The same may be true one day with federalized education funding.

To be honest, I doubt fixing our school funding system is high on Bernie’s list of things to do. Breaking up the big banks, overturning Citizens United, free college tuition, even healthcare probably come first. And maybe that’s not a bad thing. If any or all of these goals were realized, it would help the more than half of our public school children living in poverty. Moreover, just having equitable funding on the list with these other worthy goals puts it on the national agenda.

Right now, no one else is talking about this. It isn’t even a recognizable goal for most progressives. Frankly, I doubt many people have even thought about it. By bringing this up, Bernie is forcing us to do so.

When I first became an education activist, I thought I was doing it for my students. Then we had a daughter, and I thought I was doing it for her, too. But as the years have gone by, the landscape has changed only slightly. We’re still reaching a level of critical mass when the culture demands a major shift. We’re not there yet. So now I wonder if the people I’m really doing this for are my grandchildren.

One day we may have the courage to change the course of our education system. We may gain the nerve to actually accomplish our convictions. We might actually try to have a nation with liberty and justice for all.

That’s what I’m fighting to achieve. I think many of us are doing the same. But do we have the bravery to take Bernie at his word, to push this topic onto the national stage?

A Bernie Sanders presidency would do that. It might not achieve this lofty goal. Not now. The political winds aren’t favorable. But we can try, knowing full well the dangers and the improbability.

I wish Bernie would flesh out the details of his plan. I wish he’d exorcise the devil from the details. But the very fact that he has the intrepidity to offer this as a solution fills me with hope.

F is for Friedrichs… and Freeloader: A Supreme Court Nightmare

Say you’re on an airplane flying high over the Rockies.

The plane is going down.

You need a parachute.

Luckily, before you took off, all the passengers got together and pooled their money to buy them.

There’s enough for everyone. We’re all going to make it out of this alive.

People line up at the doors getting ready to jump.

Right in front of you is a lady with a sour look on her face.

“I can’t believe they’re making us pay for these parachutes,” she says.

“Really?” you reply. “Don’t you want one?”

“Sure I do!” she says. “I just don’t think I should be forced to pay for it.”

You give her a look. You can’t help it.

“But how else can they buy the parachutes?” you say.

She puts her hands on her hips and says, “There are some people on other airplanes that don’t have parachutes. I don’t think it’s fair that I get a parachute when they don’t have one.”

“You could just leave your parachute here on the plane and jump without it,” you offer helpfully.

She makes a face looking down at the parachute she’s been provided. “Will you look at this?” she says. “Mine’s blue.”

“So what?” you say. “So is mine.”

“I hate blue. I don’t want my money going to buy blue parachutes.”

“Um. At least you’ll have a soft landing.”

“A soft BLUE landing without my Constitutional rights.”

Just then a hole breaks open in the back of the plane sending air whooshing through the cabin. Oxygen masks fall from the ceiling. The plane shudders back and forth before the hole is plugged and cabin pressure returns.

A man with a similar sour expression comes forward to both of you. He is wearing a military police uniform and has a whistle in his mouth. He blows it.

“Did I hear right!?” he bellows. “Is this woman being forced to pay for her parachute!?”

“Yes,” you say after a moment. “She wants one.”

They both look at you like a third arm is growing out of your forehead.

“That’s beside the point,” the military man spits. “She can’t be FORCED to pay for it!”

By this time, a woman makes her way to the three of you from the front of the plane. She is wearing a beret and an armband.

“What’s the problem back here?” she asks.

“The problem is that this woman is being forced to pay for her parachute!” the MP says.

“Do you want a parachute?” beret woman asks the sour jumper.

“Of course,” the woman says.

“Then why shouldn’t you pay for it?”

“Because it’s blue,” she says.

“Are you kidding me?” beret woman asks. “Of course it’s blue. We got those on sale. The only way we could afford parachutes for everyone was if we bought in bulk and bought blue.”

“I don’t care,” the jumper says. “I shouldn’t be forced to buy a blue parachute if I don’t want one.”

“But you DO want one,” you say.

“Not a blue one,” she responds.

“Just give it back,” you say.

“No,” she replies stubbornly.

“That’s it,” the MP says drawing his gun. “Both of you, give me your parachutes.”

“What!?” you say.

“You heard me, Flyboy!” he says opening a huge rucksack. “Everyone on this plane! Put your parachutes in this bag!”

Everyone groans but does as he commands. After all, he’s holding a gun.

“Now what?” the sour jumper says once all the parachutes have been collected.

“Now I’m going to return all of these to the store,” he says.

“Huh!?” you say.

“It’s the only fair thing to do. You’ll each have to come back to the store and pay for your own ‘chutes.”

“But we’re on a plane plummeting out of the sky!” you say.

He turns to the sour jumper. “You’re welcome,” he says. “My job here is done.”

You turn to beret lady. “Isn’t there something you can do?” you ask.

“I’m afraid not,” she says. “Even if we could go back to the store, we can’t afford to buy everyone a parachute unless everyone pitches in. And even then only the blue ones are on sale.”

The military man salutes and jumps out of the plane. After he falls an appreciable depth he pulls his own rip cord. You can see his parachute balloon open. It’s bright red.

You turn to beret girl. “Who was that guy?” you ask.

Air Marshal Alito,” she says before making her way back to the front of the plane.

The nose of the cabin dips down. The sound of rushing wind is intense.

You turn to the sour jumper. “Are you satisfied now?” you say. “We’re all going to die.”

She slumps to the ground. Her head falls off. She’s hollow. She was just a mannequin.

You sit back in your seat stunned.

You put on your belt.

“I don’t want to pay for any seat belts,” comes whining from the mannequin’s head rolling on the floor.

You kick it out of the plane.

And smile.

Before you crash.

And experience a fiery death.


 

Meanwhile on the ground, Air Marshall Alito is shaking a man’s hand. The man is from Wall Street. He just made a small fortune betting the plane would crash. His name is Koch.

He gives Alito a suitcase full of greenbacks. He turns to another man, the owner of Friedrichs’ Mannequin Manufacturing. He gives him another similar suitcase.

These suitcases contain just a fraction of the money Koch has won betting on the demise of the airplane passengers.

He is laughing.

On the suitcases it says, “Right to Fly.”

He laughs harder.

He laughs and laughs and laughs.

EPILOGUE:

You’re still dead.


 

MORALS:

Should workers be permitted to benefit from collective bargaining without paying union dues? No. Pay for what you get or turn down the benefit.

Is collective bargaining essentially political? No. It’s negotiating fair treatment. Ebay isn’t political. Neither is this.

Is Friedrichs v. California Teachers Association a trumped-up case tailor-made for the five conservative Supreme Court justices to overturn existing law simply because they wanna? HELL YEAH!

My Daughter is Not a Widget

My daughter just turned seven during this holiday season.

She loves to draw. She’ll take over the dinning room table and call it her office. Over the course of a single hour, she can render a complete story with full color images supporting a handwritten plot.

These narratives usually star super heroes, cartoon characters and sometimes her mommy and daddy. In these flights of fantasy, I’ve traveled to worlds lit by distant suns, been a contestant on a Food Network cooking show, and even been a karate pupil to a Teenage Mutant Ninja Turtle sensei.

That little girl is my pride and joy. I love her more than anything else in this world.

Make no mistake – She is not anyone’s product.

She is not a cog to fit into your machine. She is not merchandise, a commodity, a widget for you to judge valuable or not. She is not some THING for you to import or export. She is not a device, a gadget, a doodad, a doohickey or a dingus. She is not an implement, a utensil, a tool, or an artifact.

Her value is not extrinsic. It is intrinsic.

She is a person with a head full of ideas, a heart full of creativity and passion. She has likes and dislikes. She loves, she lives, she dreams.

And somehow Tillerson, this engineer turned CEO, thinks she’s nothing more than a commercial resource to be consumed by Big Business. He thinks her entire worth as a human being can be reduced to her market value. It doesn’t matter what she desires for herself. It only matters if she fills a very narrow need set by corporate America.

But what else should we expect from the man in charge of ExxonMobil? The corporation has a history of scandal, corruption and malfeasance going back decades.

Since the 1980s the company has been suppressing its own incredibly accurate data on climate change because that science would adversely affect the bottom line of a business that earns its money burning fossil fuels. Moreover, the company funds climate change denial groups. A study by the US Union of Concerned Scientists reports that ExxonMobil funded 29 climate change denial groups in 2004 alone. Since 1990, the report says, the company has spent more than $19 million funding groups that promote their views through publications and Web sites that are not peer reviewed by the scientific community. Need we even mention the corporation’s long history with the American Legislative Exchange Council (ALEC)?

Tillerson and Exxon have also been major boosters of the fracking industry pushing for deregulation as health concerns mount. Most recently, the organization was ordered to pay a $100,000 Environmental Protection Agency civil penalty for an illegal discharge of fluids from a Marcellus Shale natural gas well site in Lycoming County, Pennsylvania.

It’s all about profit at Exxon. The corporation’s cost cutting measures also resulted in the largest oil spill in US waters to date. Environmental impacts are still being felt in Alaska’s Prince William Sound from the 11 million gallons of oil the Exxon Valdez supertanker unintentionally poured into the ocean, coasts and forests in 1989. Subsequent spills have occurred in Brooklyn (2007), the Yellowstone River (2011), Baton Rouge (2012), and Arkansas (2013). But why should that matter? The corporation was listed as the second most profitable in the world on the Fortune 500 in 2014.

Yet Tillerson is somehow worried about American workers being up to snuff? Why? The corporation outsources a steadily increasing share of its jobs overseas. Those that it does keep in the continental US have been subject to massive downsizing efforts. As employees have decreased, corporate profits have increased. And Tillerson expects anyone to think he’s concerned about the well-being of the American worker!? Give me a break!

I suppose it’s not that surprising though that someone who makes $40 million a year, himself, would expect a paycheck to be the ultimate display of personal significance. After all, he probably thinks his exorbitant salary proves that he’s very important.

Albert Einstein never made that kind of money. Heck! Neither did William Shakespeare, Dr. Martin Luther King, Marie Curie, or Abraham Lincoln. So by Tillerson’s ethos, all of these people were defective products unfit for the corporate world. Or at the very least our estimation of them is flawed.

After all, what need have we of Shakespeare’s poetry in the exercise of buying and selling? Perhaps the greatest author ever to write in the English language might find merit in the advertising department. Likewise, Dr. King’s ethic of equality might be useful in human resources. Marie Curie? She’d find gainful employment in research and development but any patents she generated would undoubtedly be held in the corporate interest. And Mr. Lincoln? Perhaps he could be useful as a low level administrator but, no, such iconoclasm as he possessed would probably not be a good fit. He’d end up freeing the wage slaves or other such unprofitable nonsense.

Is this really the American Dream? Find an occupation producing monetary wealth or else lose all claims to value? If so, how loud must history be laughing at us?

The post-Impressionist artist Van Gogh created 900 paintings and 1,100 drawings and sketches. Many of these works now adorn museums around the globe and have forever changed the way we see the world. But during his lifetime, he sold only one painting. So by Tillerman’s logic, he was a defective product, a failure.

This is the sickness of the profiteer – to be forever appraising worth but unable to see true value. It is the disease eating away at the soul of our country. It’s the same mindset that justifies anything in the name of short-term gain – credit default swaps, the housing bubble, charter schools and Common Core.

After all, Tillerson’s notorious quote above comes from an infamous article in Fortune magazine in which the CEO threatened the former governor of Pennsylvania that he’d pull ExxonMobil out of the state if the legislature didn’t adopt some form of Common Core. And so the state gave in to the whim of one man with no experience, knowledge or wisdom about how children learn. And students in more than 500 public school districts are thus constrained by this legal economic blackmail.

I am but a simple man. I don’t bring in a six-figure salary. I’m a teacher in that same public school system. I’m also the father of an elementary student. I am a man of no monetary means and thus little merit. But I say this: the Tillersons of this world are wrong. Our children are worth more than these tiny bean counter brains realize. The purpose of education is not to provide more resources for their pointless game of Monopoly.

My daughter has a life, and her education is a tool to enrich that life. It is her vehicle of understanding the world around her. It is a process to invigorate her sense of wonder. It is a method of understanding how things work and where she fits in the universe.

Yes, she will one day need to seek employment. But what she chooses as her occupation will be up to her. SHE will decide where she fits in, Mr. Tillerson, not you. SHE will decide what is valuable in her life. SHE will decide if she wants to spend her hours in the pursuit of profits or less tangible enterprises.

As such, she needs literature – not standardized tests. She needs mysteries to solve – not Common Core. She needs equitable resourcesnot charter schools. She needs teachers with advanced degrees and dedication to their jobs – not Teach for America temps.

Don’t you dare try to justify all that with some narrow economic view of monetary value. Some things have no price. My daughter is one of them.
